Short Term Rental Agreement

This agreement explains policies for this property. Our goal is to exceed expectations and ensure you have an amazing beach vacation. If you have any questions, please call, text or email and we will respond as quickly as possible.



Rental Agreement

This agreement is a contract between the Guest (you, your) and Owner (we, us) of the vacation rental property. By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your rental is a transient rental under FL State Law. Your tenancy is temporary for the defined time period only. The property cannot be sublet or assigned to another individual. No repairs, alterations or improvements can be made to the property.

Reservation Confirmation

Your reservation is confirmed when we receive your booking with an advance payment of 50% of the rental rate for your stay. The Guest must be 25 years old to make a reservation. This Guest is the responsible party for the reservation and rental requirements.

Payment

At the time of booking, an advance payment of 50% of the rental rate is required. This payment will be applied to the total rental rate for the booking. The balance of the rental agreement is due 60 days prior to your arrival date. Reservations made less than 60 days prior to arrival will be required to pay in full at time of booking.

Credit Card Authorization

Guests consents to the use of the credit card provided without original signature on the charge slip and a copy of this agreement will be used as an original. Owner shall provide a damage protection policy to the renter for incidentals that cover up to $5,000. This is for accidental damage to the property and does not include:


1-Smoking cleaning fees. Smoking/Vaping in the unit is NOT allowed. A $500 cleaning fee is applied for any smoking.


2-Pet damage/pet cleaning. Pets in the unit are NOT allowed. A $500 cleaning fee is applied for any pet cleaning.


3-Missing items.


The property is inspected before and after each stay. We ask that you report any issue or damage immediately so it can be resolved in a timely manner.

Cancellation

Cancellations made more than 60 days prior to your arrival date will receive a refund of any payments made minus a $100 cancellation fee. Cancellations made within 60 days of check in date will not receive a refund. Travel insurance is recommended for all bookings.


Travel insurance is available through multiple carriers. Travel Guard is recommended. Unexpected weather or circumstances can delay or cancel travel plans. Travel insurance helps you protect your travel investment. Information can be found on their website at www.travelguard.com or by calling 800-826-5248. Coverage offered by Travel Guard Group, Inc. and terms and conditions will apply. Please contact them or another provider for more information and to protect your vacation.



Occupancy

Maximum occupancy is 6 guests for this 2 bedroom unit. This policy is strictly enforced at Leeward Key. If you are found in breach of this contract, your lease will be terminated and no refund will be issued. Only guests that are registered in the reservation stay overnight.

Insurance

You are not covered by any insurance policy held by us. You have the option to carry renter insurance to cover your personal belongings.

Amenity or System malfunction

In the instance that there is an issue with an amenity provided at the unit, (beach service, pool, fitness facility, etc.) No refund will be given for failure to access this amenity. In the event of a system issue, including but not limited to water, sewer, air-conditioning, heating, major appliances, entertainment equipment, structural systems, ventilating, etc. we shall repair them in a reasonable manner. You agree to permit access to the unit by contractors to make necessary repairs. We shall not be liable to the renter/guests for damages or for the temporary loss in the system in need of repair.

Taxes and Fees

All renters agree to pay the Owner the rental rates for the days of booking, applicable state and local taxes, and a cleaning fee of $275.00.

Parking

Parking is allowed in designated parking spots only. Parking passes are available in the unit or at the front desk. Please keep parking passes visible in your vehicle/vehicles during your stay. If you use a pass provided by Owner at the condo, please return the pass before check-out.

NO SMOKING / OPEN FLAMES

No smoking is allowed. No vaping is allowed. No open flames / candles are allowed. If this rule is disregarded, the additional smoke cleaning fee will apply.

Conditions Beyond Our Control

We are not liable for events beyond our control that may interfere with your scheduled booking. This includes but is not limited to, acts of God, fire, tornado, hurricane, topical storms, inclement weather of any kind, government agency situations, uncontrollable loss of services, or travel delays/cancellations. There will be no refund and we recommend the purchase of travel insurance.

Falsified Reservations

If you provide false information concerning your identity or any aspect of the reservation and will not be granted access to the property. You will not be refunded any money paid and we are obligated to report fraud to the authorities.

Criminal Activity

Renter and guests agree not to engage in any criminal activity/conduct on the property. This includes but not limited to: use of illegal drugs, committing a felony, violating laws or ordinances, or engaging in conduct for unlawful purposes. Owners are not liable for damage or injury you cause to yourself or to others/3rd party while engaging in criminal activity.

Indemnification

Owner shall not be liable for any damage or injury suffered by you, guests, invitees, agents, employees or any person entering the property. You agree to indemnify and hold us harmless from any and all claims or assertions.

Acknowledgement

You have agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, no smoking policy, no pets allowed and cancellation policies.
